That does not mean that the service is free, since between 6 and 7 million euros have come out of municipal budgets each year to compensate the company.

Not satisfied with these amounts, Avanza-Portillo went to court in 2020 to claim a deficit between 2016 and 2019, prior to the "free payment", of almost 4.5 million euros.

The concessionaire has won the lawsuit and the sentence will be final shortly after the City Council has considered it unfeasible to appeal in cassation.

Therefore, this money will have to be paid from the municipal coffers, which will be added to the annual amounts once the service has been "free."

According to the documentation to which Marbella24horas24horas has had access, the principal is 3,917,719 euros, plus 552,343.83 euros in interest.

In total, 4,470,062.83 euros more for Avanza-Portillo for a service that is advertised as "free."

Adjustment plan

This is one of the three sentences for which the City Council will have to resort to the Planning Fund to pay them with a credit of 18 million euros, which requires an adjustment plan.

In addition, there is another for a claim from 2019 as a result of an agreement for the transfer of urban development uses. In total, you have to pay 3.1 million euros.

And the third, the largest, for a fair price fixing also raised in 2019 for the Hacienda San Manuel estate, which amounts to 11 million euros.

In total, the three add up to a payment of 18,603,510.44 euros that the City Council must face and for which it will resort to the Planning Fund.
